These Terms of Use apply to the Services currently offered by iCreative as well as Services that may be offered in the future.

YOUR USE OF THE SERVICES CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT AND INDICATES YOUR WILLINGNESS TO BE BOUND BY THESE TERMS OF USE.

iCreative is not responsible for inaccurate information provided through the Services and makes no representations as to the accuracy, reliability, timeliness, or completeness of Content, including without limitation, the description, availability or effectiveness of any product or service. Services include, but are not limited to phone, website, in person, or any media whatsoever. iCreative does not assume any liability for any loss that may result from the reliance by any person upon any Content provided through the Services. 

iCreative reserves the right to permit or restrict any user's access to the Services, in its sole and absolute discretion, including the termination of user accounts in the event of a breach of these Terms of Use by the user, and including iCreative retains the right, in its sole and absolute discretion, to refuse to sell a product or products to a person, a business or a Company. 

All content including, but not limited to, what you provide and what iCreative provides, phone conversations, emails, websites, videos, and any type of transmissions, are owned by iCreative.

iCreative shall not be subject to any obligation of confidentiality. By providing information, you hereby grant the Company/iCreative, a perpetual, worldwide, irrevocable, unrestricted, non-exclusive, royalty-free right and license to use, copy, edit, license, sublicense, adapt, distribute, display, publicly perform, reproduce, transmit, modify, create derivative works from, and edit any such Content for any purpose, commercial, advertising, or otherwise on or in connection with, or relating to any product, and/or products, the Services, or the promotion thereof. 

Furthermore, by using our Services, you agree to defend, and hold harmless, iCreative, its parents, affiliates, and subsidiaries, together with their respective employees, agents, officers, directors, shareholders and licensees, from and against any and all threats, and claims of alleged or actual infringements of any intellectual property rights, proprietary rights, rights of privacy and publicity, moral rights, and rights of attribution raised by any third party against the iCreative Parties and you agree to reimburse the iCreative Parties for any loss, damage, defamation of character or costs incurred as a result.

You agree that you will neither post nor submit any User Generated Content in any manner whatsoever, nor will speak anything about iCreative and its parties which includes but is not limited its staff, owners, founders and any Parties that is unlawful, rude, disrespectful, slanderous, defamatory, derogatory, nor encourage others to do so. Violating this will result in Legal Action and you shall incur all costs, including claims for any and all damages. 

POSTAL ADDRESS AND DELIVERY

Make sure the address you have on checkout/payment is CORRECT as your items will be sent to THAT ADDRESS and we are not liable or responsible if you made a mistake or do not inform us of any changes at the time of purchase. If paying with PayPal, we send to your PayPal address, unless advised differently at the TIME of actual payment. 

REFUNDS

Refunds are NOT offered under any circumstance, including, but not limited to a change of mind. 

IF you deem a product/s to be faulty you must contact us within 72 hours of item/s being delivered, and you may be required to provide evidence including sending the item/s back to us for an Analysis. If it is not found to be faulty or if it has been tampered with, iCreative will not reimburse you for the postage or any other costs associated with the return of the product/s and the product/s will NOT be replaced. 

Tracking numbers are provided on all orders within Australia. You will be advised of your Tracking Number and it is your responsibility to track it with Australia Post and to liaise with Australia Post if you have any queries regarding it. 

ORDER

Your order/s is/are subject to the acceptance by iCreative and at its sole and absolute discretion, iCreative retains the right to refuse an order or orders without giving a reason. By using this website and placing an order, by any means, you are agreeing to these Terms and Conditions and at no time are you to decide what the Terms and Conditions are. Any complaints made to PayPal or other that is not removed when requested is violating our Terms and Conditions. This may see you removed from any correspondence from iCreative and may result in future orders NOT being fulfilled; any payment for a future order that iCreative does not want to fulfill will simply be reversed/refunded. 

Any offer made made by iCreative is strictly limited to 48 hours only unless stated otherwise. Any offer may end earlier if sold out of that which is being offered.

Any offer by iCreative can strictly not be transferred or cross over to any other brand/s that it may be associated with. Any offer for a photo that is featured and offering a discount to use our Services is strictly to be used and paid for within one calendar month from the offer being put forward.

TIME TO PROCESS 

All orders are processed in the order of which they are received.  You must allow at least 28 WORKING DAYS. for your order to be processed and sent and during unprecedented times such as now with COVID-19 it is acceptable to allow a longer time period. If you do not agree to these Terms and Conditions, please refrain from placing an order. We are very busy with filling orders and upholding our contracts with multiple locations throughout the world and we appreciate your understanding. 

INTELLECTUAL PROPERTY

Our Intellectual Property includes but is not limited to logos, photos, names, drawings, wording, tag lines, products, recipes, and creations. 

You do not have permission to use iCreative logos, photos or any of our information or IP without the written consent from iCreative, which will also be subject to Terms and Conditions. 

LIABILITIES

You understand that the use of the Services is at your own risk. 

You agree to be responsible for any and all claims, including third-party claims, liability, damages and costs, (including, but not limited to legal fees, costs and expenses) against or incurred by the iCreative Parties that result from, arise out of or are in any way connected to your breach to these Terms and Conditions/Terms of Use, your negligence, wilful misconduct or your infringement, lack of communication or ill feelings. 

These Terms and Conditions of Use sets forth the entire understanding and agreement between you and iCreative.

LEGAL ISSUES

Free Postage and Handling does not apply on Sales.

Any legal issues will be dealt with and governed by the Laws in South Australia
